Welcome to Liacare. These Terms of Service constitute "a legally binding agreement between you" and Alexander Khazanov, operating as Liacare, regarding access to liacare.co and digital product purchases.
By accessing the Site or purchasing, you agree to be bound by these Terms. Disagreement prohibits Site usage or product purchases.
Liacare operates in pre-release digital capacity, offering a "Digital Priority Pass" for $25.00 USD.
The Pass grants:
Liacare utilizes Lemon Squeezy as exclusive Merchant of Record. "All payments, order processing, secure financial data storage, fraud prevention, invoicing, refund processing, and global tax calculations" are handled by Lemon Squeezy.
Your transaction is "subject to their respective Terms of Service and Privacy Policy." Liacare does not directly process or store payment card data.
The Digital Priority Pass includes a "100% refund guarantee." Full refunds are available "at any time, for any reason" provided the 40% discount remains unredeemed.
Once the discount applies to a hardware purchase, the Pass becomes "strictly non-refundable." Contact business@liacare.co to request refunds via Lemon Squeezy receipts. Refunds permanently void priority status and discounts.
The physical Liacare ecosystem (Hub, Radar Nightlights, Rescue Rover) remains in development. Hardware must be purchased separately upon release.
The Digital Priority Pass "does not constitute the purchase of physical hardware, nor does it guarantee a specific delivery timeline" for future releases.
LIACARE IS A CONSUMER ELECTRONICS AND SMART HOME PRODUCT ECOSYSTEM. IT IS NOT A CERTIFIED MEDICAL DEVICE, IS NOT CLEARED OR APPROVED BY THE FDA.
LIACARE IS NOT A SUBSTITUTE FOR 911, EMERGENCY RESPONSE SERVICES, PROFESSIONAL MEDICAL CARE, OR IN-PERSON HUMAN CAREGIVERS. In emergencies, dial 911 or local emergency services immediately.
Despite advanced sensor technology, Liacare "DO NOT AND CANNOT GUARANTEE 100% FALL DETECTION ACCURACY" and expressly disclaims guarantees regarding fall prevention, injury prevention, health deterioration prevention, or death prevention.
Liacare relies on third-party infrastructure including home Wi-Fi, internet providers, and electrical grids. The company "EXPRESSLY DISCLAIM[S] ANY AND ALL LIABILITY FOR ANY HEALTH EMERGENCIES, INJURIES, WRONGFUL DEATH, OR PROPERTY DAMAGE RESULTING FROM MISSED ALERTS OR SYSTEM FAILURES."
THE BUYER AND THE MONITORED USER ASSUME ALL RISKS ASSOCIATED WITH THE USE OF LIACARE PRODUCTS.
The purchaser frequently differs from the individual monitored in their home.
"It is illegal to monitor individuals without their consent" under US federal and state privacy laws. Buyers represent they have "obtained the explicit, fully informed, and legally valid consent" of the monitored individual or their legal representative to install devices.
Buyers agree to indemnify and defend Liacare against claims arising from consent failures.
IN NO EVENT SHALL LIACARE… BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, including personal injury, wrongful death, or data loss.
LIACARE'S TOTAL AGGREGATE LIABILITY shall not exceed THE AMOUNT YOU PAID TO US… IN THE PAST TWELVE (12) MONTHS.
These Terms are "governed by the laws of Israel, without regard to its conflict of law provisions."
Disputes resolve "exclusively through binding, individual arbitration administered in Israel." Both parties waive jury trial and class action rights.
