Welcome to Liacare. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Buyer," "Caregiver," or "you") and [Insert Your Full Legal Name in Latin characters], an individual doing business as Liacare ("Liacare," "we," "us," or "our") governing your access to and use of our website located at [Insert Website URL] (the "Site") and the purchase of our digital products.

By accessing the Site or purchasing a product, you expressly agree to be bound by these Terms. If you do not agree to these Terms, you are strictly prohibited from using our Site or purchasing our products.

1. CURRENT OFFERING: THE DIGITAL PRIORITY PASS

At this time, Liacare is operating in a digital, pre-release capacity and does not sell physical hardware directly through the Site. We currently offer a digital product known as the "Digital Priority Pass" for a one-time fee of $25.00 USD.

Purchasing the Digital Priority Pass grants you:

Instant digital delivery of the proprietary Liacare Digital Guide (provided as a PDF).

A guaranteed forty percent (40%) discount locked in for a future purchase of the Liacare physical hardware ecosystem, redeemable upon official launch.

2. MERCHANT OF RECORD & E-COMMERCE PAYMENTS

To ensure the highest level of global tax compliance and payment security, Liacare utilizes Lemon Squeezy as our exclusive and authorized Merchant of Record (MoR). All payments, order processing, secure financial data storage, fraud prevention, invoicing, refund processing, and global tax calculations (including US Sales Tax, VAT, and GST) are handled entirely by Lemon Squeezy.

By completing a transaction on our Site, you acknowledge and agree that your transaction is conducted with Lemon Squeezy and is subject to their respective Terms of Service and Privacy Policy. Liacare does not directly process, collect, or store your payment card data.

3. REFUND POLICY

The $25.00 Digital Priority Pass is fully backed by a 100% refund guarantee. You may request and receive a full refund of your purchase at any time, for any reason, provided that the 40% hardware discount has not yet been redeemed.

Once the 40% discount is applied to a physical hardware purchase, the Digital Priority Pass fee becomes strictly non-refundable. To request a refund, please process the request through your original Lemon Squeezy order receipt or contact us at [Insert Contact Email]. Upon issuance of a refund, your priority status and 40% discount will be permanently voided.

4. FUTURE HARDWARE & SCOPE OF SERVICE

The physical Liacare ecosystem (including, but not limited to, the Liacare Hub, Radar Nightlights, and Rescue Rover) is currently in development. When officially released, all hardware must be purchased separately. Purchasing the Digital Priority Pass does not constitute the purchase of physical hardware, nor does it guarantee a specific delivery timeline for future hardware.

5. EXPRESS MEDICAL & EMERGENCY DISCLAIMER (READ CAREFULLY)

When the Liacare Hardware ecosystem becomes available, its use will be strictly subject to the following limitations. By using our Site and purchasing our products, you acknowledge and agree to the following:

5.1. Consumer Electronics, Not a Medical Device

LIACARE IS A CONSUMER ELECTRONICS AND SMART HOME PRODUCT ECOSYSTEM. IT IS NOT A CERTIFIED MEDICAL DEVICE, IS NOT CLEARED OR APPROVED BY THE FDA, AND IS NOT A PERSONAL EMERGENCY RESPONSE SYSTEM (PERS).

5.2. Not a Substitute for Professional Care

LIACARE IS NOT A SUBSTITUTE FOR 911, EMERGENCY RESPONSE SERVICES, PROFESSIONAL MEDICAL CARE, OR IN-PERSON HUMAN CAREGIVERS. IN THE EVENT OF A PERCEIVED MEDICAL EMERGENCY, YOU MUST IMMEDIATELY DIAL 911 OR YOUR LOCAL EMERGENCY SERVICES.

5.3. No Guarantees of Accuracy or Prevention

WHILE LIACARE UTILIZES ADVANCED SENSOR TECHNOLOGY, WE DO NOT AND CANNOT GUARANTEE 100% FALL DETECTION ACCURACY. WE EXPRESSLY DO NOT GUARANTEE THAT THE USE OF OUR PRODUCTS WILL PREVENT FALLS, INJURIES, DETERIORATION OF HEALTH, OR DEATH.

5.4. Assumption of Risk & System Failures

LIACARE RELIES ON THIRD-PARTY INFRASTRUCTURE (INCLUDING YOUR HOME WI-FI NETWORK, INTERNET SERVICE PROVIDERS, AND ELECTRICAL GRIDS). WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY FOR ANY HEALTH EMERGENCIES, INJURIES, WRONGFUL DEATH, OR PROPERTY DAMAGE RESULTING FROM MISSED ALERTS OR SYSTEM FAILURES DUE TO INTERNET OUTAGES, WI-FI DROPOUTS, HARDWARE BLIND SPOTS, DEAD BATTERIES, SOFTWARE BUGS, OR POWER OUTAGES. THE BUYER AND THE MONITORED USER ASSUME ALL RISKS ASSOCIATED WITH THE USE OF LIACARE PRODUCTS.

6. CAREGIVER OBLIGATIONS & THIRD-PARTY CONSENT

Liacare’s ecosystem is uniquely designed so that the purchaser (the "Buyer" or "Caregiver") is frequently different from the individual residing in the home where the devices are deployed (the "Monitored User" or "Senior").

Under US federal and state privacy and wiretapping laws, it is illegal to monitor individuals without their consent. By purchasing our products with the intent to monitor a third party, the Buyer represents, warrants, and covenants that they have obtained the explicit, fully informed, and legally valid consent of the Monitored User (or their legally authorized representative/Power of Attorney) to install Liacare devices in their living spaces. You agree to indemnify, defend, and hold Liacare harmless from any legal claims, privacy violations, or damages arising from your failure to obtain such consent.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIACARE, ITS EMPLOYEES, OR OWNER(S) BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR PERSONAL INJURY, WRONGFUL DEATH, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SITE, DIGITAL PRODUCTS, OR FUTURE HARDWARE. IN NO EVENT WILL LIACARE’S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US (OR OUR MERCHANT OF RECORD) IN THE PAST TWELVE (12) MONTHS.

8. GOVERNING LAW & ARBITRATION

These Terms shall be governed by the laws of [Insert Your State/Country of Residence], without regard to its conflict of law provisions.
